Recent Judgements Won on Behalf of our Clients

Below are the most notable court cases our firm diligently worked on and won judgements on behalf of our clients. The cases are listed by year and includes a quick summary of what we achieved for our clients.


2018

  • April 2018 - Insurer agrees to review client's LTD claim after initially claiming it was untimely
  • February 2018 - Successfully settle claim after federal court litigation
  • January 2018 - Successful appeal of LTD claim for Fibromyalgia


2017

  • December 2017 - Successful appeal of STD claim 


2016

  • February 2016 - Settled a wages and hours claim
  • January 2016 - Resolved a claim for benefits for failed carpal tunnel release surgeries
  • January 2016 - Won an order for benefits calculating average weekly wage based on past earnings rather than a planned move to part time 
  • January 2016 - Won and order for workers' compensation benefits for incapacity due to work related mental health impairment
  • January 2016 - Successfully resolved a workers' compensation claim for benefits based on a shoulder injury by way of a lump sum agreement approved by an ALJ of the DIA.


2015

  • December, 2015 - Won an administrative appeal to UNUM, where UNUM reversed its termination of LTD benefits based on its interpretation of the policy.


2014

  • Santina D. April 2014 Denial of non ERISA LTD benefits reversed on administrative appeal to Cigna.
  • Gary H. March 2014 - Client awarded worker’s compensation benefits after severe work-related hand injury where the employer did not have workers’ compensation insurance.
  • Sandra P. March 2014 -  A Fully Favorable Decision from Michael P. Bretton, Administrative Law Judge, after a hearing to determine eligibility for social security disability benefits, based on a claim of disability due to degenerative disc disease and psoriatic arthritis.


2013

  • Santina D. November 2013 Claimant awarded SSDI benefits based on findings of peripheral neuropathy, among other ailments.
  • Clive W. November 2013 - Successful global resolution of workers’ compensation claim and third party tort action for injuries suffered as the result of a motor vehicle accident during work.
  • Bill O. November 2013 - Successful global resolution of workers’ compensation claim and third party tort action for injuries suffered as the result of a malfunction in the transmission of a work vehicle.
  • Loren G. September 2013 - Successful administrative appeal of Cigna’s denial of short and long term disability benefits for Loren, a highly successful project manager who suffers from chronic fatigue syndrome and fibromyalgia.
  • Phil S. August 2013 - Successful administrative appeal of Liberty’s termination of Phil’s long term disability benefits for an extremely rare eye disease causing corneal neuralgia of uncertain etiology that derailed a successful career as an accountant.
  • Karen M. May 2013 - Successful appeal of LTD denial against CIGNA for patient care technician with hip injury requiring replacement surgery.
  • Phil S. May 2013 Client awarded SSDI benefits upon Reconsideration based on an extremely rare eye disease (corneal neuropathy) causing intense pain and photophobia.
  • James M. May 2013 Successful appeal of a termination of LTD benefits by Prudential for a client in an ERISA governed claim who was limited to part-time work after recovering from cardiomyopathy and respiratory failure.
  • Susan O. May 2013 Successful appeal from the termination of Unum’s LTD benefits and successful award of SSDI benefits in anon ERISA claim for a client suffering from Regional Sympathetic Dystrophy.
  • Ainsley W. April 2013 Recovered more than 90% of all insurance money available to a client who suffered a facial scar during an auto accident, including recovery from workers’ compensation insurer, liability insurer and her own auto insurance policy’s underinsured coverage.
  • Barbara C. April 2013 - Decision by the federal district court in Connecticut taking 57 pages to uphold a denial of benefits in an ERISA governed LTD claim. (Hey, no lawyer wins them all).
  • Aurora F. April 2013 Client awarded SSDI benefits based on her symptoms of chronic fatigue syndrome and depression.
  • Johnny C. March 2013 Successful administrative appeal to Unum on behalf of a trial lawyer on an own occupation LTD policy denial, where the attorney was unable to continue work as a trial lawyer due to a low back injury and depression brought about by the pain.


2012

  • Jajuga v. 1st circuit, 2012 - Won $300,000 insurance disability death benefit for family, plus Prudential  legal fees and cost, where insurance company refused to pay a death benefit even though it, and the social security administration, had found Mr. Jajuga disabled.
